Calculates the increase from one year to the next in sales tax revenues from

tourism-related businesses (hotels, restaurants, camping, etc.); then takes half of that increased

revenue (beyond a base 3% increase) and puts it in the Kansas Tourism Advertising Fund

(KTAF), which is earmarked for the promotion of Kansas tourism opportunities to markets

within Kansas and in other states and countries.

Kansas currently spends less promoting tourism than any other state.

• Removing income tax from the calculation of revenue, restricting it to sales taxes only; this

greatly simplifies the administration of the bill.

• Changing “taxable year” to “calendar year” because the income taxes have been removed

from the calculation.

• Changing Standard Industry Classification (SIC) codes to North American Industry

Classification System (NAICS) codes. These are the newer classifications of businesses, and

the codes needed to be updated.

• Setting a rolling cap of $1 million per year, as the maximum that could be transferred to

KTAF in any given calendar year.

• In lines 22, 29, and 35, the dates of implementation of the formula for determining increase in

revenue have been back-dated by one year, i.e. 2003 is changed to 2002.

W/draw from Appropriations, refer to COW; authorizes DofA, thru KDFA, to issue $175 million in bonds for KDOT capital improvement projects, subject to bond covenants, and reserves, as determined by bond counsel, for KDOT to transfer $175 million of SHF funds to SGF, and for the debt to be retired over 15 years, capitalizing interest first yr, and interest only pmts only for at least first 5 years. (Oh, yes, the Legis could if it wants to use un-allocated tobacco settlement proceeds to pay off this debt, although there absolutely no mention of that in the bill.) Bottom line–proposal is to use money intended for our children/grandchildren over the next 15 yrs, and use it today to avoid current liability and anyone paying $1 more in taxes, so our children/ grandchildren can pay off the bonded indebtedness over the next 15 years! In addition this loan assumes an initial rate and continuous rate of 3.67% which will not in fact be fixed in the loan. If rates go up, then this will not work and will be out of balance by $1,750,00 per year for each 1% of increase of interest .

(1) It states finding of the Legislature regarding threat of terrorism,

importance of utilities, and need for extraordinary regulatory treatment to help enable the

government to perform its most basic purpose of providing for the security of citizens and

protecting the public welfare. (2) Tells KCC to follow certain procedures when considering cost recovery by utilities of costs of security measures. Cost recovery of money spent on security measures, whether expenses or capital investment, is expedited to incent utilities to upgrade security. Confidentiality of information is provided, including confidentiality of amount of investment in security and recovery requested, protective orders for nondisclosure by parties participating in KCC proceeding, procedures to reflect confidentiality rules of Nuclear

Regulatory Commission and other regulatory bodies, and not identifying a specific charge for

security on customers’ bills. (3) Review by KCC with input from appropriate authorized parties

(specifically including CURB) to ensure that (a) items for which expedited cost recovery is

requested provide enhanced security, and (b) the expenditures are prudent (e.g., no “gold

plating”). (4) Tells KCC not to base determinations of prudence of expenditures on security

measures on standard regulatory principles and methods of recovery [but rather on expedited

basis], and to take fully into account the findings of the Legislature regarding the threat of

terrorist actions.
