Utilities; SubBPA; Wireless Enhanced 911 (e-911) Act; creates funding mech for improvements necessary for statewide e-911 service2; two sep  charges (1) e911 tax of 25¢/mo per wireless phone no., pd to LCPA (local collection  point adm’r, ie LKM & KAC) for use by counties to implement e9113 (actually $$ goes to PSAP, the public safety answering points); (2) e911 fee of 25¢/mo on each wire­less acct & phone no, w/ revenue going to Sec Admin for “Grant Fund” avail to counties >75k population & cities in those counties, w/ specific matters money could be used for being identified4; both e911 tax & e911 fee start 7-1-04 & last thru 7-1-10; also establishes a 9 person Advisory Bd, members to be apptd by Gov from particular groups; fairly detailed in oversight (by Legis Audit, and by KCC) and reporting requirements; note liability limitation in §13; also does §16 (all PSAPs make good faith effort to “ensure” wireless calls near jurisd border fwded to appropriate PSAP) create duty/liability where “discretionary” exemption of Tort Claims Act would not?  [House amendments in Sub bill–ex­tend expiry of fee & tax from 08 to 10; KCC, not Sec Admin, audits carriers; com­panies pay for audits, not fees or SGF; & equal­ization of the taxes in smaller coun­ties at higher rate that in larg­er counties]

[“at rail” amendment – strips out all references to ‘tax’ and makes both chgs noted above just plain old fees]

1.        Dilmore Amend. Allows the wireless carrier to retain a fee of 2% of the amount charges. Krehbiel opposes so it must be a good amendment and it helps Sprint and other local wireless providers.y/f 47/70.

2.        Neighbor Amend. The audit of the carriers will not be in KCC but rather in the Dept. of Admin. This is good because wireless carriers are not regulated by the KCC now, and the cost of the audit will be paid by the State, not the carriers/users. Krehbiel opposes so it must be a good amendment. y/p

3.        Freeborn Amend. Calls the fee a “public safety”  purpose. y/f

4.        McLeland Amend. Opens your phone as to where you are, actually gets service to your county faster. (??). y/p.

5.        Huy Amend.  Takes the KCC out of the policing of compliance. I support.y/p 61/58

6.        Carter Amend. Places a 10 year limit on $$ going to local govts, i.e., the ½ of the total fee. The fee sunsets. y/f 53/64

7.       Ostmeyer Amend. n/f

8.        Yonley Amend.Allows wireless providers to recover their costs from the fee fund. y/f

9.        Powers Amend.  Sunsets the fee portion of the program in one year.
