Utilities; SubBPA; Wireless Enhanced 911
(e-911) Act; creates funding mech for improvements necessary
for statewide e-911 service2;
two sep charges (1) e911 tax of 25¢/mo per
wireless phone no., pd to LCPA (local collection point
admr, ie LKM & KAC) for use by counties to
implement e9113
(actually $$ goes to PSAP, the public safety answering
points); (2) e911 fee of 25¢/mo on each wireless
acct & phone no, w/ revenue going to Sec Admin for
Grant Fund avail to counties >75k population
& cities in those counties, w/ specific matters money
could be used for being identified4; both e911 tax
& e911 fee start 7-1-04 & last thru 7-1-10; also
establishes a 9 person Advisory Bd, members to be apptd by
Gov from particular groups; fairly detailed in oversight (by
Legis Audit, and by KCC) and reporting requirements; note
liability limitation in §13; also does §16 (all
PSAPs make good faith effort to ensure wireless
calls near jurisd border fwded to appropriate PSAP) create
duty/liability where discretionary exemption of
Tort Claims Act would not? [House amendments in
Sub billextend expiry of fee & tax from 08
to 10; KCC, not Sec Admin, audits carriers; companies
pay for audits, not fees or SGF; & equalization of
the taxes in smaller counties at higher rate that in
larger counties]
[at rail amendment
strips out all references to tax and
makes both chgs noted above just plain old fees]
1.
Dilmore Amend. Allows the wireless carrier to retain a fee
of 2% of the amount charges. Krehbiel opposes so it must be
a good amendment and it helps Sprint and other local
wireless providers.y/f 47/70.
2.
Neighbor Amend. The audit of the carriers will not be in KCC
but rather in the Dept. of Admin. This is good because
wireless carriers are not regulated by the KCC now, and the
cost of the audit will be paid by the State, not the
carriers/users. Krehbiel opposes so it must be a good
amendment. y/p
3.
Freeborn Amend. Calls the fee a public
safety purpose. y/f
4.
McLeland Amend. Opens your phone as to where you are,
actually gets service to your county faster. (??). y/p.
5.
Huy Amend. Takes the KCC out of the policing of
compliance. I support.y/p 61/58
6.
Carter Amend. Places a 10 year limit on $$ going to local
govts, i.e., the ½ of the total fee. The fee sunsets.
y/f 53/64
7. Ostmeyer
Amend. n/f
8.
Yonley Amend.Allows wireless providers to recover their
costs from the fee fund. y/f
9.

SEQ CHAPTER \h \r 1Fed & State; BPAA; prohibits
pyrotechnics (fireworks), devices and materials, in any
building which is a place of public assembly (capacity of 50
or more), and declares same a public nuisance1,
giving State Fire Marshal power to adopt rules & regs to
implement [problem noted
the amendment to the public nuisance statute (KSA
22-3904) deletes terms house and
room from recognized locations where nuisances
can be determined to exist this is not a good idea,
narrowing the scope of an enforcement tool on books since
1970 w/o rational basis; restore current law.

Right to carry/concealed carry of firearms. SEQ CHAPTER \h \r
1 Fed & State; BPA; concealed carry
euphemistically referred to as the personal &
family protection act; authorizes KBI to issue license to
carry [a permit to pack (PTP)]
concealed weapons, which holder must have in
possession; or, PTP may be reflected on drivers
license, & law enf may verify validity of license
using the persons vehicle tag &
drivers license info; PTP issued by other states
are to be recognized; persons who have been convicted of or
placed on diversion for a person felony (but not
a nonperson felony?) are not eligible, nor are those subject
to a PFA (although if the PFA is dissolved perhaps
they can pack before they get another filed against
them)7;
on p. 5 bill language places the burden of denying a license
on the KBI; may not pack in/at any professional
athletic event not related to firearms (those events
would be?), but serious question is with so many exceptions,
how is a person to know or remember all those places packing
not permitted?
- Amendments. Lots of amendments,
generally limitations as to where you cant pack
heat. I supported the amendments that restrict the folks
who cant carry.
- Amendments as to more education requires. I supported these
amendments.
- Amendments to forfeit the gun and
license if you have a concealed gun in a posted place.
Went down but I was for it.
- Amendment to allow locals to do a local prohibition. Supported
but failed.
- Lots of amendments to limit or
restrict concealed carry. I supported them and they all
went down.
